Niniejsza Polityka prywatności (w języku angielskim) reguluje sposób przetwarzania danych przez Fundację Stay Connected, ul. Lindleya 16, 02-013 Warszawa, Polska.

§ 1. GENERAL PROVISIONS

Fundacja Stay Connected (Registration number 0001063751 of XII Commercial Division of the National Court Register, District Court for the Capital City Warsaw in Warsaw) is the Controller of the personal data collected by Service.

§ 2. SERVICE

Service is electronic service for downloading software application(s) to electronic devices, such as smartphones and tablets, available at https://gate19.org.

§ 3. TERMS AND DEFINITIONS

The terms used in this Policy shall be understood and interpreted in accordance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC («GDPR»), the Act of 10 May 2018 on the protection of personal data and the Act of 18 July 2002 on the provision of services by electronic means.

§ 4. DATA PROCESSING

Processing of any data in the course of providing the Service shall be carried out in accordance with requirements GDPR and applicable laws, however the use of Service does NOT require any identification of any user, or collection of any personal data of anyone. Thus, Controller does NOT collect, store or otherwise processes any personal data unless explicitly mentioned and/or described herein.

Where any data are provided for the purpose of using Service, failure to provide such data may disable the possibility to download the software applications.

§ 5. PURPOSES OF DATA PROCESSING

Controller only processes data made available by the users of Service, for the purposes of:

• Establishing connections that allows downloading of software applications {Contractual performance},
• The fulfilment of the legal obligations incumbent on Controller in connection with running a business activity, in particular to prevent fraud and abuse of the network infrastructure {Legitimate interest}.

No other data shall be processed by Controller, unless previously agreed with users and for processing of which the explicit consent was given by users.

§ 6. LIMITATIONS OF DATA COLLECTION

Controller strictly enforces a No-Logs Policy and does NOT collect, store, or log:

• IP addresses (neither original nor assigned VPN IP’s),
• Browsing history, destination traffic, or DNS queries (other than the automatically retrieved connection parameters),
• Metadata about connection timestamps or duration of sessions.

The following data may be collected for the subscription, provision and use of Services, as well as for technical diagnostics:

• e-mail address (if registration is required),
• billing information processed via secure third-party payment gateways (App Store, Google Play, Stripe etc),
• aggregated, non-identifiable crash reports or app performance analytics (not linked to any individual user).

Controller shall store the personal data of the Users when it is necessary to maintain security, prevent fraud and abuse, as prescribed by the Act on Combating Money Laundering and the Financing of Terrorism of March 1st, 2018.

§ 7. TIME OF PROCESSING

Data of users shall be kept ONLY for the period of provision of Services, or until the revocation of the consent granted or until the objection to the processing of data — in cases where the personal data have been processed on the basis of separate consent.

§ 8. USER RIGHTS

Controller shall ensure that users may exercise the rights as stipulated by GDPR and applicable laws. In order to exercise the rights, users shall send an appropriate demand (request) via e-mail to: info@gate19.org.

§ 9. DATA SHARING

Controller shall NOT share data collected from users with any third party, unless otherwise is prescribed by applicable law.

§ 10. TECHNICAL MEASURES

Controller shall use its best efforts to secure and protect data of users from any actions by third parties, and shall supervise the data safety throughout the entire period of owning such data in such a manner as to protect the data against unauthorised access, damage, distortion, destruction or loss.

Controller uses the necessary server, connection, and website security measures. Nevertheless, the actions taken by Controller may not be sufficient if users do not follow the security rules.

§ 11. CHANGE OF THE PRIVACY POLICY

Controller has the right to change this document and users shall be notified of any such changes in a manner allowing users to familiarise themselves with the changes before they enter into force, for example by posting the relevant information on Controller’s website.

Should a user have any objections to the changes made, such user may request the deletion of his/her personal data on Service. The continued use of Service after the publication or notification of changes to this document shall be considered to be consent to the updated version of this Policy.

This Policy shall not restrict any rights granted to users in accordance with generally applicable laws.
